The Trade Marks Amendment Act of 2021 (TMA 2021) is a major development in Jamaica’s trade mark law. Jamaican company brands, logos, as well as Brand Jamaica are now able to obtain global protection. Under Section 69 of the Trade Marks Act, it is a criminal offence to use a sign or logo similar or identical to a registered trade mark. A total of 32 product standards were promulgated by the Bureau of Standards Jamaica (BSJ) in 2020. These are related to cannabis (3); hand sanitisers (1); toy safety (6); household and similar electrical appliances (5); fluorescent and led lamps (2); electric cables, insulation, conductors and enclosures (9); refrigerating appliances (3); pre-packaged goods (2); and bamboo straws (1).
